Privacy policy OMAI

OMA Insurance Inc. (OMAI) is subject to the requirements of the Personal Information Protection and Electronic Documents Act, 2000 (PIPEDA) for the services that it provides.

PIPEDA specifies OMAI’s legal requirements to protect the privacy of individuals whose personal information is in OMAI’s custody. PIPEDA defines personal information as information about an identifiable individual. OMAI also observes the GDPR, insofar as OMAI collects web-based data analytics. OMAI is committed to ensuring that your personal information is treated with the utmost respect, dignity and sensitivity.

Purposes for collecting, using and disclosing your personal information

We may collect, use and disclose your personal information for the following purposes:

  • Verify your identity
  • Understand your needs
  • Determine your eligibility for products and services
  • Provide you with the full range of products and services that we believe meet your changing needs
  • Permit affiliated and other reputable third-party organizations, our parent company, and preferred suppliers to provide products, services, and information to you
  • Complete requested transactions
  • Respond to any special needs or inquiries you may have
  • Communicate with you in a timely and efficient manner
  • Detect and prevent fraud
  • Conduct internal audits
  • Analyze data to help us make decisions and improve the products and services we offer
  • Comply with regulatory, statutory, contractual or other legal requirements
  • For other purposes consistent with the above

We will only collect information that is relevant and consistent with the purposes of the collection.

Consent for collecting, using and disclosing your personal information

We collect, use or disclose your personal information with your permission, subject to exceptions that are determined by law. Your consent may be given in writing, verbally, electronically, or through authorized representative(s), or it may be implied. Whenever practical, we will collect the required information directly from you, or from your authorized representative(s), in completed applications and forms, through other means of correspondence, such as the telephone, mail, email or the internet, and through your business dealings with us. Your personal information may include your name, date of birth, address, contact information, family status, medical information, employment information and financial information. If we require your personal information for purposes not outlined above or which were not communicated to you at the time that we collected the information from you, then we will obtain your consent to collect, use, or disclose your personal information for these purposes.

Your privacy rights

At any time, you may withdraw your consent for OMAI to collect, use, or disclose your personal information for OMAI programs, services, or sharing with a third-party organization or OMAI’s parent company. However, in dealings that involve insurance services, your decision to withhold particular details may limit or prevent us from providing the products or services you have requested. The withholding of information may also impact on how a claim is processed or how decisions are made by an insurer under the group policies. It may also make it more difficult for us to advise you or suggest appropriate alternatives. If you choose to withdraw your consent, our staff will explain to you the potential implications of your withdrawal, after which OMAI will implement your withdrawal of consent request to the best of our abilities. In all cases, withdrawal of consent is not retroactive.

You also have the right to request access to the personal information that we have collected about you, and to request a correction to this information if you believe it is inaccurate. 

Sharing your information

OMAI limits the disclosure of your personal information to what is necessary to assist in the provision of insurance products and services or for other purposes for which you may provide consent or as otherwise permitted by law.  We may make personal information available to:

  • Our insurance partners: to offer the insurance services requested (such as to secure quotations for insurance, obtain insurance coverage, or report or process claims)
  • Third-party service providers: to perform specialized services on our behalf such as printing, research, marketing, mail distribution or data processing
  • Our parent company: to receive shared organizational services such as information technology assistance and other support in order to operate our business and to provide you with the services you request from us
  • Public or government authorities, law enforcement agencies, or regulatory bodies: to comply with a provincial or federal statute or regulation or to comply with a court order

Our insurance partners and service providers may process and/or store your personal information in jurisdictions outside of Canada.  Personal information processed and/or stored outside of Canada may be subject to the laws of the country in which it is processed and/or stored. We contractually require such third parties to employ appropriate security safeguards to protect your personal information.

All insurance providers, third-party service providers and shared organizational services are provided only the personal information necessary to perform the relevant services. In addition, we require them to protect the personal information in a manner that is consistent with our privacy policies and security practices.

How long we retain your information

We will keep your personal information for as long as necessary to fulfill the purpose for which it was collected and/or to meet legal, regulatory or contractual requirements. When we destroy personal information, we will use safeguards to prevent unauthorized parties from gaining access to the information during the process.

How we protect your personal information 

The OMAI has put physical and technological safeguards in place to protect your personal information from theft, loss and unauthorized access, copying, modification, use, disclosure, and disposal. Within OMAI, access to your personal information is restricted to authorized staff who have a legitimate business purpose for accessing it. OMAI staff are educated on the importance of privacy through internal procedures and training programs. We also conduct audits and complete investigations to monitor and manage our compliance with our privacy obligations.
